Premises Liability & Slip-and-Fall Accidents

If you have been injured on the property of someone else, whether it be a business or individual, you may be able to recover for your damages. The issue following such an injury on the property of another is liability. In other words, is there something the property owner did that they should not have that created a dangerous situation or did they fail to do something that they should have which resulted in a dangerous situation. Some of these cases fall into the category of slip and fall cases or trip and fall cases. If you have suffered a serious injury on the property of another you will likely want to consult with an attorney as soon as possible.

Slip and fall or trip and fall cases can be difficult cases and the insurance company for the at fault party almost routinely denies liability or responsibility for such an accident. If you do not act fast crucial evidence could be lost. The premises or defect that caused you to fall could be changed. I have seen this happen with individuals who were injured on steps or in parking lots. Pictures should be taken as soon as possible. Witness statements taken if available. In some cases there may even be video of such an accident which may not be preserved if you do not act fast.

Following such an accident you should immediately report it to the property owner as soon as possible. You should give a detailed description of what occurred. Although it is important to inform the property owner of what occurred it is important to consult with an attorney before giving a statement to the insurance company. Insurance adjusters are trained professionals who will likely try to illicit statements from you that are not helpful to your case. Things to consider following such an accident or fall are what caused the accident or fall, where were you looking, what were you doing i.e on the phone, talking to a friend etc. The type of shoe you were wearing can also be important.

If you have been seriously injured in such an accident and would like to discuss the issues surrounding your claim or potential claim please call for a free consultation.
