Back Injuries

Throughout my career I have represented many clients who have suffered back injuries on the job. A workers’ compensation back injury can involve a sudden pain while performing your job duties or a gradual build up of pain over an extended period of time. As with any injury on the job it is important that such an injury be reported to your employer. The employer must be notified that you have suffered a back injury or that you have developed back pain over time due to performing your job duties. When you report a back injury to your employer they should report such a matter to their workers compensation carrier who will determine if they are going to provide medical care. Clients often will consult with me at this time as the insurance company may wrongly deny the claim or simply take too long to process the claim. This can be an extremely frustrating process for the injured worker. I can help you through this process.

Once you are able to get medical treatment for your injury it is important to inform the medical professional of all of the pain you are experiencing. This can included radiating pain. If you have pain running down one or both of your legs as a result of your workers compensation back injury it is important to inform the medical professional who is treating you. With injuries involving the neck, it is important to notify the medical professional of any radiating pain or numbness down ones arm. These symptoms may help the medical professional diagnose your injury. Radiating pain can also affect multiple parts of your body which can be significant in pursuing your workers compensation claim.

Back Injuries can be some of the most serious injuries in the workers compensation system. Many times these injuries involve individuals who are performing jobs which are strenuous and require constant use of the back. Back injuries can ranch from a temporary pain such as a strain or can involve a herniated disc. Back injuries can also occur when a pre-existing condition is aggravated by activities at work. Treatment for such injuries can range from rest, to physical therapy and even involve surgery.

There are many things to consider when you have suffered an on the job back injury. Will this injury prevent you from being able to perform your job? Will you be able to earn the same income following your workers compensation back injury? Will you have permanent work restrictions as a result of your back injury? Will you be entitled to future medical care for your back after your on the job injury? These are all issues that should be considered following an on the job back injury. I can help you through the process and help you determine the answers to these questions. If you will not be able to return to your job, earn the same income and/or need future medical care these issues will have to be addressed during your workers compensation case to insure that your interest are protected.
